Here  is a basic description of the different types of assault crimes under Minnesota law:

  • First Degree Assault. Assaulting another and inflicting great bodily injury, assaulting a peace officer or attempting to assault a peace officer with deadly force.
  • Second Degree Assault: Assaulting another with a dangerous weapon and inflicting substantial bodily harm.
  • Third Degree Assault: Assaulting another person and inflicting substantial bodily harm, or assaulting a child with a previous pattern of abusive behavior against a child.
  • Fourth Degree Assault – assaulting a peace officer, EMT, ER doctor or nurse, firefighter, correctional officer or natural resources employee, or assaulting another based on a bias or prejudice.
  • Fifth Degree Assault: Threatening another in such a way as to place them in immediate fear of bodily injury, or inflicting or attempting to inflict bodily injury on another person.
  • Domestic Assault: Assault committed against a spouse, ex-spouse, family member or person in a romantic relationship.
