Third Degree Burglary: Burglary in any other circumstances when the defendant enters a building without consent and commits a felony or gross misdemeanor.

Fourth Degree Burglary: Burglary in any other circumstances when the defendant enters a building without consent and commits a misdemeanor other than theft.
