The severity of a DWI in Minnesota depends upon whether one, or more, aggravating factors are present at the time of the offense. These include:

- DWI with a child under the age of 16 in the vehicle, if the child is more than 3 years younger than the defendant.
Following are the potential DWI charges that a defendant may face in Minnesota:
- First Degree DWI: DWI with three, or more, prior drunk driving convictions, or one prior felony DWI conviction in the most recent ten years.
- Second Degree DWI: DWI with two or more aggravating factors present at the time of the offense.
- Third Degree DWI: DWI with one aggravating factor present at the time of the offense.
- Fourth Degree DWI: Driving or operating a motor vehicle, or boat, while under the influence of alcohol, under the influence of a controlled substance, under the influence of any hazardous substance that the defendant knows affects the brain or nervous system, with a blood alcohol concentration of .08% or greater, with a blood alcohol concentration of .04% or greater if the defendant is driving a commercial vehicle, or with any amount of a Schedule I or II controlled substance in his or her system.
