- The defendant places the victim in reasonable fear of serious injury;
- The defendant uses a weapon in the commission of the crime;
- The defendant injures the victim by using force or threats;
- The defendant injures the victim and knows or should have reasonably known that the victim was physically helpless or mentally impaired/disabled; or
- The defendant commits the offense with the help of others.
Third Degree Criminal Sexual Conduct: Sexual penetration in any one or more of the following circumstances:
- The victim is under 13 years old and the defendant is less than 3 years older;
- The victim is 13 to 15 years old and the defendant is 2 years older than the victim;
- The victim is 16 or 17 years old and the defendant has a significant relationship with the victim;
- The victim is 16 or 17 and the defendant is in a position of authority or power over the victim and is 4 years older than the victim and uses this power to get the victim to submit;
- The victim is 16 or 17 years old and the defendant has a significant relationship with the victim and uses force, threats or coercion, places the victim in reasonable fear of serious injury, causes injury to the victim or commits multiple acts over time;
- The defendant uses force or coercion to commit the offense; or
- The defendant is a health care professional or psychotherapist and the victim is a patient and the act occurs under the guise of a bona fide medical purpose or occurs during a therapy session.
