Certain elements that may cause sexual assault to be classified in this degree may include: a victim under the age of 13 and a defendant who is less than 3 years older, the use of force or coercion, a victim who is physically helpless or mentally impaired, or an offense committed by a health care professional under the guise of a bona fide medical purpose.
- Fifth Degree Criminal Sexual Conduct: Any nonconsensual sexual contact, including the attempt or actual removal of clothing that covers the victim’s intimate parts.
