This is a misdemeanor offense under Minnesota law and may be punishable by up to 90 days in prison. However, there are situations where shoplifting may be classified as a felony offense. If a defendant has prior shoplifting convictions, he or she may face felony charges. The same may apply if the value of property involved is valued at $500 or more, or if a string of shoplifting offenses is involved. In these situations, a defendant may face up to 5 years in prison and/or a fine of up to $10,000 (for property valued at $500 to $2,500).

A defendant in the Twin Cities area may also face criminal charges for the possession of shoplifting instruments. Possession of a device or instrument that is designed to aid an offender in committing shoplifting is a criminal offense in itself, such as a tool that is designed to remove security tags from store merchandise so the offender can carry it from the store without setting off the alarm.
